Employers should give careful consideration to the questions used in their employment applications, because often the application itself has a direct affect on the outcome of background screening.
Topics to be discussed include:
- What information is used to perform a background check?
- Is it appropriate to ask about arrest or conviction records?
- Are questions regarding physical traits, disabilities, age/date of birth, garnishment history, credit history, citizenship and drug abuse history reasonable questions to ask an applicant?
- What questions violate the Americans with Disabilities Act (ADA) or Equal Employment Opportunity Commission (EEOC)?
