On May 13, 2011, Georgia passed the Illegal Immigration Reform and Enforcement Act which now requires private employers to first register and use the Federal government’s E-Verify system before issuing or renewing business licenses or occupational tax certificates.

E-Verify is a program managed by the Department of Homeland Security in conjunction with the Social Security Administration allowing employers to electronically verify the work eligibility status of new employees, whose Social Security and alien ID numbers are checked against U.S. records.

The bill takes effect in three separate stages:

  • Effective 01/01/12 for employers with 500 or more employees
  • Effective 07/01/12 for employers with 100 or more employees but fewer than 500
  • Effective 07/01/13 for employers with more than 10 employees but fewer than 100
